Rubbish Clearance Wimbledon Service Terms

These Terms and Conditions set out the basis on which Rubbish Clearance Wimbledon provides waste removal, rubbish collection and related services. By placing a booking or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming a collection or clearance.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, company or organisation requesting and paying for the services.

We, us, our means Rubbish Clearance Wimbledon, the waste collection service provider.

Services means any rubbish clearance, waste collection, bulky waste removal, loading, transportation, disposal or related work we agree to carry out for the Customer.

Waste means any items, materials or goods that the Customer asks us to remove, including household, commercial, garden and bulky waste, subject to legal and safety restrictions.

Site means the property, premises or location where the Services are to be carried out.

2. Scope of Services

We provide rubbish clearance and waste collection services within our stated service area, which may be updated from time to time. Services may include collection of bagged waste, loose items, furniture, appliances and similar materials, subject to these Terms and Conditions.

Our Services do not cover specialised hazardous materials such as asbestos, gas bottles, clinical waste, chemicals, solvents, oils, fuels or any substance that we reasonably consider unsafe or unlawful to handle or transport. We reserve the right to refuse to remove any item at our discretion where health, safety or legal compliance is at risk.

We will use reasonable care and skill in providing the Services, but we do not guarantee that any particular item can or will be removed, especially where access is restricted or removal might cause damage to the Site or surrounding property.

3. Booking Process

Bookings for waste removal services can be made by telephone, email or other communication methods we accept. When you contact us, we may ask for information about the type and approximate volume of waste, property access and any special circumstances.

Any quote given before arrival is based on the information you provide. It is an estimate only and may change once our team has inspected the Waste at the Site. If the actual volume or nature of the Waste differs from what was described, we will revise the quote and seek your approval before proceeding.

A booking is accepted and a contract formed only when we confirm the booking and, where required, you have accepted the quoted price and any call-out or minimum charge. We reserve the right to refuse any booking at our discretion.

You must ensure that you have authority to arrange the Services at the Site and that, if you are not the owner, you have the owner’s consent for rubbish clearance to be carried out.

4. Access and Customer Responsibilities

The Customer is responsible for providing safe and suitable access to the Site and to the Waste to be collected. We may require access through internal or external areas, stairways, lifts, driveways or communal spaces. You must ensure that such access is permitted and safe for our operatives and vehicles.

You must ensure that parked vehicles, gates, doors and other obstructions are moved or opened so that we can reach the Waste. Failure to provide access may result in additional charges, including reasonable waiting time, call-out charges or cancellation fees.

You must ensure that the Waste is clearly identified for removal, separated where requested and free of prohibited or hazardous items. If we reasonably believe that waste has been misdescribed or mixed with prohibited items, we may refuse to collect all or part of it or may apply additional charges for safe handling.

5. Pricing and Payment Terms

Unless otherwise stated in writing, our charges are based on the volume, weight, type of Waste, labour involved, and any additional services requested such as dismantling, packing or sorting. We may also charge for parking, congestion or access-related costs where applicable.

All prices are quoted in pounds sterling and are exclusive of any applicable taxes unless clearly stated otherwise. We reserve the right to revise our price lists and rates at any time, but changes will not affect confirmed bookings already accepted.

Payment is due on completion of the Services unless alternative terms have been agreed in writing in advance. We may accept payment by cash, card or other methods we notify you about. For commercial Customers or account holders, different payment terms may apply and will be confirmed separately.

We reserve the right to charge interest on overdue sums at the statutory rate from the date payment falls due until the date of actual payment in full. The Customer is responsible for all reasonable costs of recovering overdue amounts, including debt collection and legal fees.

6. Cancellations and Changes

If you wish to cancel or rearrange a booking, you must notify us as early as reasonably possible. We may apply a cancellation charge where a booking is cancelled or significantly changed on short notice, particularly if our team has already been dispatched or if a specific time slot has been reserved.

We may cancel or reschedule the Services if we are prevented from attending the Site by events beyond our reasonable control, including severe weather, accidents, vehicle breakdown, road closures, strikes or illness. In such circumstances, we will use reasonable efforts to inform you and to rearrange the booking as soon as practicable.

If on arrival we are unable to carry out the Services due to factors within your control, including lack of access, unsafe conditions, unauthorised waste or failure to obtain necessary permissions, we may charge a call-out or wasted journey fee, together with any additional costs incurred.

7. Waste Handling and Environmental Compliance

We operate in accordance with relevant waste management legislation, duty of care obligations and environmental regulations applicable in the United Kingdom. We will transport and dispose of Waste only at authorised facilities or through approved channels.

By engaging our Services, you confirm that you understand and accept your own duty of care responsibilities as a producer of waste. You must not knowingly present fake, illegal or hazardous materials as ordinary waste. If you do, you may be liable for additional costs, fines or legal consequences.

On request and where appropriate, we may provide documentation relating to the transfer of Waste, such as a waste transfer note. You should retain any such documentation for your records in accordance with applicable law.

We may recover from you any costs, penalties, fines or expenses we incur as a result of your failure to accurately describe the Waste or your failure to comply with waste regulations.

8. Customer Property and Site Condition

We will take reasonable care when working at the Site. However, waste removal is a manual and sometimes heavy-duty process. You should protect or remove any fragile items, floor coverings or decorations that may be at risk. We are not responsible for normal wear and tear or minor scuffs that may occur despite reasonable care.

If removal of particular items requires dismantling, cutting or other methods that may cause some damage, we will seek your consent before proceeding. Where you agree, you accept that such damage may occur and that we are not liable for cosmetic repairs unless caused by our negligence.

You must tell us about any hidden defects, weak structures, unstable surfaces or other hazards at the Site that could affect the safety of our operatives or the public. We may refuse to proceed or may suspend the Services if we consider the conditions unsafe.

9. Liability and Limitations

Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot lawfully be limited or excluded.

Subject to the above, our total liability to you arising out of or in connection with the Services, whether in contract, tort including negligence or otherwise, is limited to the total price paid or payable for the specific Services giving rise to the claim.

We are not liable for any indirect or consequential losses, loss of profits, business interruption, loss of opportunity, or loss of data arising from or in connection with our Services, whether foreseeable or not.

We are not responsible for items that you intended to keep but that were placed with the Waste or not clearly separated. You must ensure that all personal or valuable items are removed before we commence work. We are under no obligation to search for or retrieve any such items once removed.

10. Insurance

We maintain appropriate insurance cover for our operations, including public liability insurance, in line with industry practice. Details of our insurance arrangements may be made available to you upon reasonable request.

11. Complaints and Service Issues

If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible with full details of the issue. We will investigate your complaint and aim to resolve it promptly and fairly.

You must notify us of any alleged damage or service failure within a reasonable timeframe and, where possible, before our operatives leave the Site. Failure to inform us promptly may affect our ability to investigate and may limit any remedy available.

12. Data Protection and Privacy

We collect and process personal information such as names, contact details, addresses and payment information in order to provide and manage our Services, handle bookings, process payments and communicate with Customers.

We will handle personal data in accordance with applicable data protection laws in the United Kingdom and will take reasonable steps to keep such information secure. We will not sell your personal data to third parties. We may share data with service providers who assist us in delivering the Services, where necessary and lawful.

13. Amendments to Terms and Conditions

We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulation, industry practice or our business operations. The version in force at the time you make a booking will apply to that booking.

We may publish updated terms on our standard service documentation or other written materials. Continued use of our Services following any update will constitute acceptance of the revised Terms and Conditions.

14. Assignment and Third Parties

You may not assign, transfer or subcontract your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary to provide the Services.

No person other than the parties to this agreement shall have any rights under or in connection with it under applicable third party rights legislation, unless expressly stated otherwise.

15. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services provided, whether contractual or non-contractual, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the provision of our rubbish clearance and waste collection services.

16. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation we provide, constitute the entire agreement between you and us relating to the Services. You acknowledge that you have not relied on any statement, promise or representation that is not set out in these Terms and Conditions or in writing from us.

If any provision of these Terms and Conditions is held by a court or competent authority to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By confirming a booking with Rubbish Clearance Wimbledon or by permitting our operatives to commence work, you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions.
